Lucknow. The Uttar Pradesh government on Wednesday praised the Supreme Court's decision on bulldozer action, saying that this decision will help in curbing organized crime and instilling fear of law in criminals. A spokesperson of the state government welcomed the Supreme Court's decision and said, "The first condition of good governance is the rule of law. From this point of view, the decision given by the Supreme Court today is welcome. This decision will create fear of law in the minds of criminals and it will be easy to curb organized professional criminals under mafia tendencies."
The spokesperson said, "The rule of law applies to everyone. Although this order was in the context of Delhi. The Uttar Pradesh government was not a party to it." The spokesperson said that this case was related to Jamiat Ulema-e-Hind vs North Delhi Municipal Corporation and others. Earlier, the Supreme Court reacted strongly to the recently trending 'bulldozer justice' and issued guidelines on Wednesday regarding the demolition of properties and said that executive officers cannot be judges, they cannot convict the accused, and cannot demolish his house.
No demolition should be done without giving a 'show cause' notice.
A bench of Justice B R Gavai and Justice K V Vishwanathan said that if people's houses are demolished just because they are accused or guilty, then it would be completely unconstitutional. While giving the verdict, Justice Gavai said that it is not a good thing that women and children stay on the streets all night. The bench directed that no demolition should be done without giving a 'show cause' notice and no demolition should be done even within 15 days of issuing the notice.
Instructions not applicable in these cases
The bench directed that the demolition proceedings be videographed. The bench made it clear that if there is unauthorized construction on public land or demolition has been ordered by the court, then its instructions will not be applicable there. It said that in the light of the Constitution and criminal law, the accused and the convicts have certain rights and safeguards. The Supreme Court gave this order on the petitions requesting to set guidelines for the demolition of properties in the country.
