Sambhal. After the uproar during the Court Commissioner Survey of the mosque in Sambhal, every person in the country wants to know what is Court Commissioner Survey. Who becomes the Court Commissioner? Is he an administrative officer or a police officer? Or neither. Is the Court Commissioner a lawyer? What is the survey, due to which the objection took a violent turn in Sambhal? Earlier, the Court Commissioner Survey was also been done in the legal disputes of Gyanvapi in the religious city of Kashi. News 18 got to know the entire process of Court Commissioner proceedings through a Chaupal with the lawyer and other advocates of the temple side of Varanasi. Subhash Nandan Chaturvedi, the advocate of the temple side associated with the Gyanvapi case in Varanasi, said that in both Varanasi and Sambhal, the lawyer of the court has been appointed as the Court Commissioner.
This happens in most cases. The court appoints an advocate of the court as court commissioner. He is accompanied by one or two assistant court commissioners. Any advocate except the plaintiff and the defendant's advocates in case of a legal dispute between two or more persons and institutions so that impartiality is maintained. This court commissioner is the eyes of the court in a way who goes to the spot and tests the claim of the case on the touchstone of law. Senior advocate Umesh Pathak said that for this the court commissioner also gets videography and photography done. After this, whatever he saw and understood in the stipulated time, he prepared a report and submitted it to the court. After that, the court decides the direction to take that case forward.
The court can also appoint any revenue official as court commissioner.
Senior advocate Jaishankar Shrivastava said that one thing is worth noting here that if the court wants, it can appoint any revenue official such as Amin or any senior employee as court commissioner in this revenue case. Sometimes it may also happen that after the report of the lawyer appointed as court commissioner, the court can also appoint any revenue official as court commissioner and get another report for cross-checking so that a decision can be taken after understanding the difference between the two reports.
The government has no role in the Court Commissioner Survey.
Senior Advocates Sanjay Shrivastava-Praveen Shrivastava said that the work or role of the police and administration is only to complete the Court Commissioner action without any hindrance. That means, overall, the government has no role in the Court Commissioner Survey. Senior Advocate Ranvijay Tripathi said that if any party accuses the government of harassment or bias, it is not proven correct from the legal point of view because this is completely a court proceeding. Senior Advocate Dhirendra Prasad Dubey said that it can be understood why one party has a problem there.
