Prayagraj. Allahabad High Court commented during the hearing of an important case that a case of sexual desires between husband and wife is not cruelty. If the husband does not demand satisfaction of physical desires from his wife, then where will he go in a civilized society? The court declared the allegation of the cruelty of dowry harassment baseless and canceled the ongoing criminal case. This order has been given by Justice Anish Kumar Gupta on the petition of husband Pranjal Shukla.
The wife had lodged an FIR in the women's police station of Noida accusing her husband of dowry harassment and unnatural sex. In the FIR lodged on 23 July 2018, the wife said that she was married in December 2015. The husband is an engineer. The in-laws demanded dowry. The court, while investigating the FIR, found that there was no concrete evidence of harassment or assault. The quarrel between the couple was over the satisfaction of sexual desires.
The wife had accused the husband.
The court said that if a man does not demand physical relations from his wife, then where will he go to satisfy his desire in a morally civilized society. The wife said that her husband was addicted to drinking and demanded unnatural relations from her. He often watched obscene? Films and roamed around naked in front of her. She said that her husband left her with her in-laws and went to Singapore. When she went to Singapore after eight months, she was ill-treated.
The court said that there is no evidence that confirms the allegation of demanding dowry. The High Court said that the dispute between the husband's evidence confirmsion of physical relationship.
